Ballot Measures by state:

Even if your state does not have a specific ballot initiative, your vote will impact the future of reproductive rights in this country. It's never been more important to vote for candidates at the federal and state levels who are committed to protecting access to abortion.


Florida

six-week ban

Floridians Protecting Freedom has completed signature collection and a proposed amendment to enshrine abortion rights in the state constitution can appear on the ballot in November. This citizen-led ballot initiative, designated on the 2024 ballot as Amendment 4 and titled the “Amendment to Limit Government Interference with Abortion,” seeks to create a constitutional amendment that would protect Floridians’ freedom to access abortion, stating: 

No law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider. This amendment does not change the Legislature’s constitutional authority to require notification to a parent or guardian before a minor has an abortion.

Maryland

Until viability

This November, Maryland voters will have the ability to enshrine the right to reproductive freedom, including an abortion, into the constitution through a ballot measure. Marylanders can show their support of the ballot measure by voting “yes” during the general election in November 2024 and learning more about the ballot initiative at MDreprofreedom.com.

New York

Until viability

This November, voters in New York have the ability to bar discrimination on the basis of pregnancy, pregnancy outcome and reproductive healthcare as part of a broader equal protection amendment. It would also bar discrimination on the basis of sex, sexual orientation, gender identity, national origin and disability.

Arizona

15-Week Ban

On May 1, the Arizona State Legislature repealed the enactment of an 1864 law that placed a total ban on abortion access. As a result, a restrictive 15-week ban without exception for rape or incest is in place. However, Arizonans remain in limbo while a determination is made as to whether the total ban will go into effect as early as June 27 for a 90 day time period.

Arkansas

Banned in almost all circumstances

Voters in Arkansas have until July 5 to gather nearly 91,000 valid signatures in order to get the Arkansas Abortion Amendment on the ballot. The amendment is citizen-led and would prevent the state from restricting access to abortion up to 18 weeks after fertilization or in the instance of rape or incest, fatal fetal anomaly, or when abortion is needed to protect the pregnant woman’s life or physical health. Colorado

No gestational limit

If you live in Colorado, it is critical to note that there are currently dueling efforts on abortion in the state. One measure would ban abortion throughout pregnancy, and the other one—led by Coloradans for Protecting Reproductive Freedom—would amend the state constitution to protect it, while also requiring Medicaid and private health insurance to cover the procedure. Missouri

banned in almost all circumstances

There are multiple ballot measures making their way across the state of Missouri, but the petition that would garner the most protections and guarantee that abortion is legal until viability is being driven by Missourians for Constitutional Freedom. All petition signing must happen in person, and you can register on their website for signing locations.

Montana

Until viability

Montanas Securing Reproductive Rights is a citizen-led initiative working to secure reproductive rights, including the right to abortion, for Montanans in the state constitution. The amendment would bar the government from denying the right to abortion before viability or when it’s necessary to protect the life or health of the pregnant person. In order for the language to appear on the ballot in November, they must gather over 60,000 signatures by June 21. Nebraska

12-week ban

The Protect Our Rights campaign is a ballot initiative to protect abortion rights in the Nebraska state constitution. The campaign needs to collect 125,000 signatures by July 5th in order for the constitutional amendment to appear on the ballot. Find in-person opportunities to sign the petition below.

Nevada

24-week ban

Nevadans for Reproductive Freedom have been gathering signatures and received approval over the language for a ballot initiative that would enshrine abortion access for the first 24 weeks of pregnancy or later to protect the health of the pregnant person into the constitution.

South Dakota

banned in almost all circumstances

Dakotans for Health are attempting to gather enough signatures by May 7 to get a measure on the ballot that would loosen restrictions in the state. It would ban any restrictions on abortion in the first trimester of pregnancy and it would allow the state in the second trimester to “regulate the pregnant woman’s abortion decision and its effectuation only in ways that are reasonably related to the physical health of the pregnant woman.” While this does not go as far as many abortions rights advocates would like, it does offer women in the state better access. Since the U.S. Supreme Court overturned Roe v. Wade and removed the nationwide right to abortion, 14 states have restricted our freedoms and access completely.

Another seven states have placed restrictive limits on accessing the procedure, ignoring the health needs of people in their state and putting an increased financial burden on those who must travel in order to access this sometimes life saving procedure. Today, one in five abortion seekers will travel out of state to access abortion care. In states like Idaho that have total bans, doctors have been forced to put patients experiencing severe pregnancy complications on emergency flights to other states.

18 million people of reproductive age no longer have access to abortion care in their state.

The last elections have made it clear: Americans value freedom. In every election since The Supreme Court overturned Roe v Wade, voters in seven states—California, Kansas, Kentucky, Michigan, Montana, Ohio and Vermont—have gone to the polls and protected abortion access through ballot measures. It’s an issue that wins across party lines. When it comes to reproductive freedom, we stand together.
